Entrapment on Old Pacific Highway

I received the email below from the MCC regarding an entrapment of motorcyclists on the Old Pacific Highway, that I thought you might be interested in.

You may be interested in a little scam and entrapment exercise the NSW Highway Patrol have been running recently on the old Pacific Hwy at Mooney Mooney just North of the Hawkesbury River.

The Old Pacific Hwy is a favourite for motorcycle riders on weekends and many hundreds will make their way along its scenic winding length visiting the cafes and restaurants, meeting and socialising, particularly when it is a fine sunny day as it was last Sunday (Sept 16th 2012).
Taking advantage of the fine warm conditions the NSW Highway Patrol set up a TRAP for Motorbike Riders where they waited on a gravel verge in a grey Nissan X-Trail SUV for riders to round a bend whereupon the Nissan SUV blasts off the verge in a shower of dust and accelerates into the path of the Riders then suddenly slowing and forcing the riders to either brake heavily or if they think the SUV is actually politely waving them past, actually overtake by momentarily crossing the double white lines, which can be done very quickly and safely (on a motorbike) and is what my companion, I and many others did on the day.
The sting then takes place a few kilometres down the road where a couple of Highway Patrol cars pick up the riders and book them after being radioed their details by the SUV team who have recorded the whole shabby ENTRAPMENT exercise on video.
We would like to request that other parties such as perhaps yourself who are interested in the appropriate and ethical application of the law and traffic regulations for the good of the community and not just the revenue target needs of the NSW Highway Patrol and the NSW State Government, could ask the NSW Highway Patrol how this ENTRAPPMENT sting really contributes to improving road safety and what impact it will have on the reputation of the Police in the community being targeted by this shabby revenue raising scam.

I am also looking to find as many other riders caught up in this scam and put together a formal joint complaint and legal response and would appreciate it if you could distribute this message.

If I didn't know better I would call bullsh1t on this but I have ridded that stretch of road many times and the coppers there are particularly nasty. Ever since a couple of amateurs on R6's outran the pursuit cars and bikes they have never forgiven the motorcycling community.
Forget entrapment this is criminally dangerous, these guys will kill someone carrying on like this.

Go back there to that verge,where they park and throw a bunch
Of gang nails n sharp metal spikes

Cost them,on flatt tyres n

Tryn fix that copers

And then they cant do it
Or go back there,with a service road crew
And barracade ,block off,no parking signs
Waste desposal site or
Just dump land fill on the entire area
So no one can park there

it doesnt matter if it is bullshit ,i just sent it to the police commissioner asking to explain his hwy patrol officers actions,if you ride your a target no matter what ,in fighting about if a thread is bullshit or not will harm us as a group ,stick together and stick it to the cops.

If the SUV waves you past you are legally obliged to follow the direction of the police. Not doing so is an offence under Aust Road rules 2008.



Division 3 Obeying directions

304 Direction by a police officer or authorised person

(1) A person must obey any reasonable direction for the safe and efficient regulation of traffic given to the person by a police officer or authorised person, whether or not the person may contravene another provision of these Rules by obeying the direction.
Maximum penalty: 20 penalty units.

Note. Authorised person and police officer are defined in the Dictionary.
(2) It is a defence to the prosecution of a person for an offence against a provision of these Rules if, at the time of the offence, the person was obeying a direction given to the person under subrule (1).

i copied and sent this as a complaint to the n.s.w police,7 days ago i just had a phone call from the gosford hwy patrol telling me he kjnew of said operation ,but it was hornsby high way patrol ,and it is now n official complaint ,as he told me the officer might have got what they were doing ,wrong,

OK ive just recieved an email from the hornsby highway patrol basically telling to to f#*k off as this operation is non of my bussiness

ok let see if this works,ok i know how to save and upload everything ,but its like the cops have a file hold over the letter bc i cannot shift it from were it is sent,il keep trying Wtf[/code]
