Hey there club members I was chatting to a fellow Busa rider and he has informed me that once someone initiates a club ride as we all want to do there becomes an insurance problem sort of if somebody comes a cropper that they are leagally allowed to make a claim against the person that has organized the ride . If there is anybody out there that can shed some light on this it would be much appreciated hint hint (ac boosa) just where do we stand on this

Well the way i see it,if your gonna sue your mate who organized a ride for your own stupidity (falling off) then what sort of mate are you????? Come on guys,lets not get like the americans!

I agree wholeheartedly Rod! Its just not the Aussie thing to do, however, it is an unfortunate reality that liability now encroaches into our social lives and our recreational activities.

My understanding is that, as long as the "group rides" aren't too structured, then a person making a claim can't prove negligence against the "ride organiser" since it really wasn't "organised" in the first instance. (In a civil case, the case is proven on the balance of probabilities)

That's why its always a good idea that, at every stop, riders are given the opportunity to "go their own way"; this takes the onus (and therefore implied liability) from any other rider. I am by no means a lawyer and would appreciate feedback on my view of public liability from any lawyers out there.

The other "Aussie" side of me say that, in the event of a claim against a ride organiser or other party on a group ride (not withstanding criminal neglingence) then the plaintiff gets what they deserve by way of a thorough indoctrination into the rites of Motorcycle gangs ie if you shit on your own, then expect to get shit on yourself

I agree with you guys but the fella i was talking to he and his mates also just started a 4x4 club and on their first outing a lady fell over and broke her leg she then sued the club and won so is what he is saying worth any consideration at all??????

Sounds like the 'club' ORGANISED the event, and that's the problem.

I'm with Julie on this one. I think there is a difference between 'organising' an event and suggesting a bunch of us meet up and go riding. Otherwise you'd never be able to ask any one down to the pub without accepting liability at the same time. We'd all be drinking on our own.

Do you really think ,that if i fell off my bike on a group organized ride,by my own doing,that i would run to my solicitor and say,"Lets sue the arse off the guy who organised this?"And if there are people in this club who think like this,that is very sad!

So can the ride organiser in turn sue Demeester for setting up the club who inturn sues ezpost for supplying to board? Cmon... the chick who broke her leg was probably told she could attend if she balanced on the roof of the 4bie while they travelled, consequently fell off and sued for being forced there. Maybe she got away with that. But she cant sue for attending and herting herself. If i joined a chess club and fell down the stairs i could sue the organiser... bullshit. There would be no clubs of any type.

If i organise a ride and someone comes off, i may have to consider finishing them off with a chainsaw to make it worthwhile. Dont try it, or your house might burn down.

Well that is the impression I am under also how can ya sue someone for taking a corner at the wrong speed or hitting gravel I know the yanks would find a way but I really hope us Aussies aren't that stupid and petty.I also rang the south east QLD MC club and those bastards wont even let you ride with them until you have passed and recieved an experienced riders certificate basically for the above question and they do have a liability insurance in place.... so guess what lil brown bear aint riding with those bunch of wankers ever... thanx for the replies guys and gals
