HELP

hey guys i have a huge prob and i really need some advice ,

i have 2 project bikes i sold over 12 months ago on eBay to a guy in VIC 1 is a runner and 1 was spares . he paid for them and hasn't picked them up in 12 months and I'm stuck with them . hes come up with some topnotch excuses as to why he cant come up and end of last yr he was told he has cancer which i do feel very bad about , Ive tried to sell the bikes but its a buyers market and no 1 wants to pay what he paid . i advised him a few times by email and fone that the bikes have to go ( my mums getting the shits as well) and hes done nothing to remove them . hes on a pension from what I'm told . i said to him i would re advertise them on eBay and he said if it makes more than the sale price he would like the profits to that i said "no way" hes only given me $50 for keeping the bikes here the 12 maths . I'm not sure what to do guys , i don't want to rip people off ever but i need something done . i cant afford to send the money back as i have that allocated some where else and i feel i have been stuck with these bikes and will be for every if i dont do something soon ,

most of you know me and i wouldn't ask for peoples opinions unless it was important . and this problem has me stressed

Sounds like he's had more than enough time to arrange collection BK....tough situation....tell him he's got 1 week to collect or they go out on the footpath with a "FREE TO GOOD HOME" sign, and keep his money. Or, ask him if he's got relatives in Sydney (nearly everyone knows someone in Sydney) and dump them off to them.
Someone else may have a better idea, but that's the best I could come up with that was reasonably sensible (I have a few other suggestions that appeal to the arsehole in me).

yeah thats very true but i dont want it to get to a point where i become an ashole as its really really bad for other people when i get like that ,

i try and treat every 1 the same way i want to be treated , its got me down alittle to be honest

Put them on Bikes only transport to be paid by person colecting bikes in Melbourne , Bikes only will hold bikes for him to pay freight and have delivered in Melbourne

Rod i did advise him of that but he didnt want to pay that kinda freight . i did speak to my lawyer and he advised me that after the 12 mths i am the owner under the abandonment clause for motor vehicles and if the other partie tryed to make me pay it would be lol out of court .


i still want him to have the bikes i just want them gone . i feel bad that hes crook and cant get them but at the same time hes had 12 mths to sort it out

that's an interesting dilemma, BK Confused

.....so he's paid for the bikes in full? + given you an extra $50, being for storage for 12 months, because he can't manage to come up and pick them up?

To my way of thinking, Kev....you are not in any way obliged to "baby-sit" his property after the sale has been completed, for any indefinate length of time.....regardless of his (allegedly unfortunate) personal circumstances.

If I myself was in this situation, I would be doing the following:

* I would immediately be checking with dept. of fair trading as to what my legal rights/responsibilities are in this awkward situation. http://www.fairtrading.nsw.gov.au/Consum...icles.html

* I would then ring him asap and be asking him straight up: "do you still want the items you have paid for and failed to take possession of"?

* If he answers YES.....then I would be telling him he has "xx" amount of time to arrange to have them picked up by a certain date.

* If he answers NO.....I would be informing him of his obligations and responsibilities and also my own rights as to laws in regards to "abandoned vehicles".

He may well be telling you the truth about his personal situation.....and he also may well be full of total B.S. ?!?
At the end of the day, whatever his personal circumstances are......that doesn't help your situation, does it?!?

I think Bazzman is on the money. Find out your legal obligations and go with those. It is not reasonable to assume that you would store the goods for a year regardless of the person's circumstance. I'd be pretty sure you would have to give him warning first and a deadline, but fairtrading should be able to help you with all of that.

yeah heidi bazz is spot on , i just got off the fone to "FAIRTRADEING" and im told i have done everything upto date correctly

Between $100 and $500 The trader/store must give written notice to the consumer and each other person claiming an interest in the goods, that they intend to dispose of the goods.
If the goods remain uncollected after 3 months of that notice, they may be disposed of by public auction or by private sale for a fair value

so im sending this all to the guy and im putting these bikes on ebay for sale AGAIN and im getting rid of them

ahh bruce there 2 kawasakia GPX 750's mate and there that delapitated its not funny . and i think heidi mite be right as well . you will need to hire staff to maintain your bikes soon just like jay leno
guys these are the 2 bikes that im talking about . as you can see they are just about FARKED .
i could turn the GPX into a track bike up until it was sold it was a really quick road bike took it up the putty and its handled 160km's really easy

how long have they being sitting since they were last started the red and white one obviously and will it need a motor rebuild??

mate i know we just spoke on FB but i think honestly this is not the bike you need mate it needs a total ground up resto . look for something modern mate up to date and current. thats my opinion ,

and i really cant sell these bikes just yet . fairtradeing is helping me sort this debarcle out .

and im pretty sure some of the good members would also advise you of the same
