Remember reading on here (just couldn't find the post) someone mentioning how you are not required to remove your helmet at the bowser unless they ask you to do it before you fill up.
Anyway I'm sick of taking the lid on and off so I thought I'd go up and pay without taking it off.
Get into pay and there's a line up of 4 or 5 people - lady at the counter tells me to remove my helmet while I'm lining up. I think "stuff it" and leave it on. Get to the counter and tell he " I know my right, etc, you can't force me to remove my helmet after I've filled up, etc". She doesn't like me being a smart-arse as she perceives it and tells me to "never come back to that station again"
I say "f#ck off, b#tch, I'll be back tomorrow to fill up", and walk away. Prob not the best way to handle the situation but she was on a power trip and I wasn't in a good mood to start with anyway .
So there's an example of what you can expect if you don't remove your helmet I guess.
I never remove my helmet off while fueling - trick is just remove your wallet before you enter the station to pay and they wont mind.
Else I remind them that I look worst then the main character in Jeeperscreepers......LOL
Wonder what they would say if I removed my helmet but left my head mask on? After all there's no rule about those... But when I went to court all dressed up in a sharp suit etc, I was the only one told to pull out my belt at the buckle so they could look down my pants so it may just be me. Lol.
Can they make you take it off if there is a sign? It would be great If I didn't ha e to remove my helmet every rime I fill up. At the local bp they won't start they pump till you take off your helmet WTF
When i did my bike licence course the instructors told us to leave your helmet on when you're refueling as it stops the fumes from the fuel contaminating the foam inside your helmet and speeding up the degradation of the helmet.
At risk of being the target of a fatwa, why not take off the helmet and put on a burqa?
I think a real legal advice would be warranted here. Please legal people shed some light on it.
My take on this is that there is no law that requires you to remove a helmet at the petrol station. It is just their policy to make robing it more difficult???? So being a good citizens we comply with it but only if we choose to do it. they can not enforce it or refuse service because of it.
I heard the law states that if you refuse to remove your helmet they can refuse to take your money thats what I heard............
From my very limited knowledge;
It is not a law but a condition imposed by the retailer for doing business with them.
If it is a condition, to be enforceable it should be displayed at the point of consumption ie the bowser, and not at the door entrance when you have already filled the tank. Similar to car parks having to display their conditions at the entrance and not at the exit.
I suspect you would still be charged with theft if you refused to remove your helmet but offered to pay and the attendant refused to accept the $. The co would certainly want to push there case for security. My guess is there is a good chance you would win the case (but im not a lawyer) but still have to pay legal feesetc.
Anyone want to be a test case?
Ahh... I was being a pratt...I'm very good at it I'm told! As for helmets on or off yes it is the retailers perogative to refuse to serve you...but if they want to refuse payment after allowing you to fill up then that would be their hard luck...you'd want witnesses though!

Simply by enetering the premises you are agreeing to abide by thier policy, it's not a matter of whether you agree with it or not. They can refuse you service and have every right.
While you are putting petrol in, there is a law that states that you must have your helmet on while operating a motorcycle in any way on a public road (a servo counts as public road, and puting fuel in is classed (edit: can be classed as) operating the motorcycle) so by law the Servo can not make you remove your helmet while refulling.
However entering the building to pay is "Store Policy" and they can simply only 'ask' you to abide by their own rules. No law states your helmet needs to be removed as it could potentialy be argued using discrimination laws. If they claim "store policy" and you want to stir up some trouble, then ask to see a copy of that policy first and ask them to point you to the section that states your helmet must be removed. That's my understanding anyway.
